These Terms & Conditions (“Terms”) govern your access to and use of Automessa (“Automessa”, “we”, “us”, “our”) and our WhatsApp campaign marketing platform, dashboard, website, and related services (the “Services”).
By creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility and Account Registration
You must be legally able to enter into a binding agreement to use the Services.
You agree to provide accurate, complete, and up-to-date account information.
You are responsible for all activity that occurs under your account.
2. Acceptable Use and User Responsibilities
You agree to use Automessa only for lawful, authorized, and ethical purposes.
You must:
Follow all applicable laws and regulations related to messaging, marketing, consumer protection, and privacy.
Comply with WhatsApp Business and Meta policies, guidelines, and requirements applicable to WhatsApp Business API usage.
Use the platform only for recipients who have provided appropriate permission/consent where required.
You must not:
Send spam, bulk unsolicited messages, or run campaigns that violate WhatsApp/Meta rules.
Use deceptive, misleading, fraudulent, or unlawful marketing practices.
Impersonate others, misrepresent your business, or send content that is abusive, harmful, or illegal.
Attempt to access, disrupt, or reverse-engineer the Services or systems.
We may suspend or terminate accounts that violate these Terms or applicable platform policies.
3. Account Security
You are responsible for maintaining the confidentiality of your login credentials and API access details.
You must notify us immediately if you suspect unauthorized access or security issues.
Automessa is not responsible for losses caused by compromised credentials where we have not been negligent.
4. Payments, Billing, and Subscription
Some features require payment. You agree to pay all fees and applicable taxes as per your selected plan.
Late, failed, or missing payments may result in service interruption, limitation, or account suspension.
Fees are generally non-refundable unless required by law or expressly stated otherwise in writing.
We may update pricing or plan features. If we do, we will provide reasonable notice via the platform or email.
5. WhatsApp Campaign Rules and Consent
Because Automessa is used for WhatsApp messaging campaigns, you acknowledge and agree that:
You are solely responsible for your campaign content, recipient lists, and messaging practices.
You must obtain any required permissions/consent before sending messages to recipients.
You must respect opt-out requests and stop messaging recipients who request not to be contacted.
You must comply with all privacy and data protection requirements applicable to your use of recipient data.
Automessa does not provide legal advice and does not guarantee that your usage complies with all laws or third-party policies.
6. Compliance with Meta / WhatsApp Policies
Automessa operates in connection with WhatsApp Business API and may be subject to Meta/WhatsApp enforcement actions.
You understand that:
Meta/WhatsApp may limit, suspend, or terminate your access for policy violations, quality issues, or other reasons.
Automessa is not responsible for restrictions imposed by Meta/WhatsApp that are outside our control.
You must keep your messaging practices aligned with WhatsApp/Meta requirements to avoid disruptions.
7. Data Protection and Privacy
Your use of the Services is also governed by our Privacy Policy.
You are responsible for ensuring you have the rights and permissions to upload, process, and use any recipient/customer data.
Automessa may process data only to provide and improve the Services, maintain security, and meet compliance obligations.
8. Service Availability and Changes
We aim to keep Services available, but we do not guarantee uninterrupted operation.
We may update, modify, or discontinue parts of the Services to improve performance, security, or compliance.
Scheduled maintenance or emergency fixes may cause temporary downtime.
9. Intellectual Property
Automessa and its software, branding, design, and content are owned by us and protected by applicable intellectual property laws.
You receive a limited, non-exclusive, non-transferable right to use the Services while your account remains active and compliant.
You must not copy, resell, sublicense, or exploit the Services without written permission.
10. Suspension and Termination
We may suspend or terminate your access if:
You violate these Terms or applicable Meta/WhatsApp policies
You engage in prohibited marketing practices or misuse the platform
Payments are overdue
We must do so to comply with legal or security obligations
You may stop using the Services at any time. Certain obligations (e.g., payment, compliance, indemnity) may survive termination.
11. Disclaimers
Automessa provides the Services on an “as is” and “as available” basis.
We do not guarantee delivery rates, conversions, business outcomes, or uninterrupted access.
Messaging outcomes may be affected by Meta/WhatsApp limitations, user device/network issues, policy enforcement, or recipient behavior.
12. Limitation of Liability
To the maximum extent allowed by applicable law:
Automessa will not be liable for indirect, incidental, special, consequential, or punitive damages.
Our total liability for any claim related to the Services will be limited to the amount you paid to Automessa in the [last 30/60/90] days (choose one) before the event giving rise to the claim.
13. Indemnity
You agree to indemnify and hold Automessa harmless from claims, damages, losses, and expenses arising from:
Your campaigns, messages, recipient lists, and content
Your violation of laws, regulations, or Meta/WhatsApp policies
Your misuse of the Services
14. Governing Terms (Global)
These Terms apply globally. If any provision is found unenforceable, the remaining provisions remain in effect.
